The Law

Despite industry efforts to find suitable alternatives, the state of Utah has implemented the Child Protection Registry law with the intended purpose of protecting children from inappropriate content delivered via email. The state of Michigan has constructed similar email laws, and it is anticipated that they will be in affect very soon.

The Law specifies that email marketing messages advertising or linking to any product or service that a minor is legally prohibited from purchasing, viewing, possessing, participating in, or receiving are strictly forbidden.

The state of Utah has established a "do-not-email" registry similar to "do-not-call" lists, where individuals residing in Utah may register any email address, or entire Internet domains to which a minor may have access on this list.

Am I or Is My Business Affected?

If you answer yes to either of the following questions, you are affected and need to STOP sending email until you formally assess the risks involved:

  • Is my business associated with any of the following?
    • Any alcoholic beverage or product;
    • Any form of tobacco;
    • Pornographic materials; or
    • Any product or service that is illegal in the state of Utah (whether purchased by a minor or an adult), including but not limited to illegal drugs, firearms, prostitution, and gambling.
  • Do I send offers for any services or products that are illegal to distribute to anyone under the age of 18?

As a business sending email communications to your current and potential customers, you should be concerned about the implications of this new law. Even if your company is not directly engaged in selling cigarettes and alcohol, for instance, your email message could contain elements that are deemed inappropriate.

Consider that emails containing information related to vacation destinations, hotels, R-rated movies, wholesale club membership information and video game titles could be viewed as inappropriate. Messages that you may be completely accustomed to could be perceived as inappropriate for minors.

The Effects

Businesses are responsible to compare — or "scrub" — their email lists against the state registry on a monthly basis, for which they must pay a per-email-address fee.

  • Utah's fee is currently set at one half of a cent ($0.005).*

*This does not include the cost to interface with the registry or scrub and catalogue the email lists.

Those businesses that do not comply, and are found to have sent an inappropriate email to an address on the list, could face considerable state fines, civil lawsuits and even jail time.
